This is indicative of the enriched nature of the river bottom soil. This area is regularly mowed and manicured.
In addition there are about 35acres of jungle and in the western half of the property, 50 overgrown acres formerly planted with Tahitian limes. Two streams originate in the western end of the property and flow eastward into mango creek. These two streams contains fresh water year round, one being located on the north and one on the sound perimeters of the property. Mango Creek flows northward past the east end of the property and varies in width from some 30 to 60 feet and in depth from about 10 to 15 feet as it passes. The river has a tide of some 12 to 15 inches. The top few feet of the river is fresh water with abrackish bottom level; some 200ft. of the waterfront has been cleared and planted with exotics, this area is high ground. The remaining waterfront area is mangrove lined. The river front on the opposite side of the river from this property is completely undeveloped and covered with native vegetation.
A road runs from the waterfront area to the western end of the property where it joins an all weather road that leads in about 2-3miles to savannah Forest Station and the paved spur road from the Southern Highway that goes to Independence and Big Creek.
We have seen Jaguar, coimundi, bushdog, fox, iguana, rabbit, deer, porcupine, agouti(gibnut), javelina ad numerous other animals on the property and crocodiles in the creek, also parrots, toucans and dozens of other species of birds. This is a quite and very secluded large piece of property suitable for resort development, housing development or for use as private estate. Laws Relevant To Land Transactions in Belize

This message here relates to a Brief description about the Transaction of Land in Belize.

  1. PURCHASE OF PROPERTY IN BELIZE

    STEPS TO BE TAKEN:

    1. Title search must be conducted on the seller’s title.  This involves conducting title
       searches of registered liens and encumbrances, cautions and supreme court actions in the Lands Registry, Companies Registry and the Supreme Court.  Kindly note that we do not carry out physical inspections of the seller’s property. We would need a copy of the seller’s title to carry out this task.

     

    1. Physical Inspection of the property should be carried out by the purchaser at his own discretion.
    1. Once the title search determines that the seller’s title is free and clear of all registered liens and encumbrances and derives of a good root, the transfer documents are prepared.

     

    1. The seller must then produce a tax receipt showing the property taxes are paid for the current year, and the original land title.
    2. Once we have prepared the transfer documents, we normally federal express them to the purchaser to have them executed in the presence of a notary public.  Then the documents are forwarded to the seller to be executed. 
    3. The executed transfer documents, the original land title and the tax receipt are then given to us to hold as escrow agents until the purchase price is paid to the seller.
    4. The purchase price at this stage is paid to the seller.  The purchase price can be paid directly to the seller or it can be wired to our US Dollar escrow account which we will then in turn pay directly to the seller. 
    5. Our invoice at this stage must then be paid which includes the stamp duty and registration fees payable to the Government of Belize.

    Costs:
    legal fees 2% of purchase price                                          
    stamp duty 5% of purchase price - government tax ( 1st 20K is exempt)
    registration fee - $15  - government tax
    New title fee - $15BZ
    central bank approval - $100BZ
    inspection of record -  $100BZ
    courier US$50 per trip
    sales tax 10% of the legal fees
    bank charge if wiring $40BZ

    1. The transfer documents are then forwarded to the Lands Registry along with the tax receipt for the stamping stage which takes 4 – 6 weeks.
    2. Once the transfer documents are returned by the Lands Registry to our office, they are then re forwarded to the Lands Registry with a check for the stamp duty and registration fees.  This is called the recording stage and it takes another 4 – 6 weeks.
    3. The Lands Registry will then return the authenticated title in the name of the purchaser, which we will then federal express to the purchaser with a copy of the notice in change in ownership letter forwarded to the Ministry of Natural Resources. 
    4. . A retainer deposit of US$1000.00 is required to act on your behalf.  This will be credited to your invoice on completion.
The Conveyance or Transfer Exercise
  1. The Conveyance of Transfer exercise usually commences either between the Vendor and the Purchaser or between one of the parties and a Real Estate Agent, representing both the Vendor and Purchaser.
  2. The Agreement sets out basic terms on which the property is to be transferred. This agreement is not an absolute prerequisite for a Transfer. It does not convey or transfer the property .
  3. Since their might be some Form of restrictive covenant or incumbrance in respect of the property for sale, it is advisable for the Purchaser to obtain the Volume & Folio of the Title in order to check whether the Title reflects correctly.
  4. The information requires for a Title search to be conducted by the Purchaser.
  5. Most Estate Agents have their own types of Purchase & Sales Agreement to expedite Transactions. We perform useful service in bringing Vendors & Purchasers together and save time so that Land Purchase can be completed within reasonable time. Generally, therefore, both Vendor & Purchaser would be well advised to retain the services of an Attorney from the outset to draft or vet the Purchase and Sale Agreement.
  6. The Ideal arrangements are for the vendor and purchaser to attend an Attorney together as this can save time and misunderstanding. As the vendor has the choice of Attorney to draw, prepare and file the Transfer documents, the Purchaser may, as a precautionary measure, have the draft vetted by his own Attorney. This will however be at the purchaser’s cost. The Attorney should as a rule confers to settle the differences before the deposit is paid. Where, on account of confidence or of costs or both, the parties decide to use the same Attorney, this decision should be recorded in the Purchase and Sales Agreement.
  7. The Purchase & Sales Agreement Form sets out the following details
    1. The names, address and occupation of the parties.
    2. If there is more than one Purchaser, the manner in which the purchasers will hold the Land as joint Tenants or Tenants in common.
    3. Description of the Land, dimensions, location and Volume & Folio numbers of the Title, in the case of registered land.
    4. Purchase price should be written in figures and words to avoid mistakes and misunderstanding.
    5. How payable, usually a 10% deposit on execution of the Agreement.
    6. Completion is at the date when the Transaction is expected to be completed.
    7. This means that the Purchaser may be liable to forfeit his deposit if he fails to complete in the time stated. (e.g.) there can be conflict between making time essence and other provisions, if therefore both provisions are to be inserted, they must be skillfully and carefully worded by an Attorney to avoid conflict.
    8. Carriage Of Sale: is the Attorney’s normally responsible for preparing, executing and lodging the Transfer documents and generally finalizing the matter.
    9. Cost of Transfer, stamp duty, Attorney’s fees, and registration fees is usually paid by the Purchaser. Possession, the date estimated for the purchaser to obtain possession is at the completion of the Transaction. By agreement between the parties the Purchaser may be given possession before completion.
The Transfer Document


This is the document which my be, among others, a First Certificate of Title, Transfer Certificate, Deed of Conveyance or Land Certificate. In respect of Titles for undeclared land the dated proposed land transfer forms must be submitted to the land Tax section of the Ministry of Natural Resources for the Commissioners certificate that all land Taxes have been paid. If the Valuation Section of the Ministry of Natural Resources indicates a value different than the consideration stated in the transfer document then the commissioner of Lands certificate will state thus and the stamp duty will be payable on that evaluation the transfer document in effect is a statement showing that the Vendor has sold the property top the Purchaser for a stated amount.
If there are two or more purchasers, then the document must state the manner in which they will hold the property, for example, whether as joint tenants or tenant in common.

The Transfer is usually accompanied by the following

  1. The original Land Title.
  2. Discharge of mortgage or discharge of a charge.
  3. Recording or registration fees and stamp duty.

The parties to the transfer must execute the transfer document before a justice of the Peace and in the case of registered land before a Justice of the Peace or Notary Public. If the transfer document is signed abroad it must be executed ( signed) before a Notary Public.

Costs

There are certain basic minimum costs which must be met by both parties on either side. These are Stamp Duty, Recording of Registration Fees, and Attorney’s Expense. These cost’s apply to, among other Recordings, registration, lease, mortgages and charges. There are other charges such as Title search, valuation report, discharge of existing mortgage, or registration of new mortgage:

(a) Closing Fees: includes registration fees, Legal fees, and Government Stamp Duty.  These fees applies to Belizean residence or Foreigners, stamp duty- $0-$10,000.00 USD = Duty exempt, $10,000.00 USD – up = 5%.
